Environmental and Zoning Appeals

You've been through a months-long permitting process and your project was still denied, or your approved project was appealed by an abutter. Now what?

You've followed all the rules and answered their every question, but were still denied a permit for your property or business. I have represented developers in appealing decisions of various municipal and state agencies, including:

  • Successfully represented developer client at the Massachusetts Supreme Judicial Court on appeal of a decision involving a town's special permit denial to expand a pre-existing nonconforming use

  • Appealing Orders of Conditions issued by Conservation Commissions to court and by requesting Superseding Orders of Conditions from the Department of Environmental Protection

  • Appealing the decisions of Zoning Boards of Appeals, Boards of Health, and Planning Boards for Building Inspector decisions, special permits, variances, pre-existing nonconforming uses, septic and sewer system matters, and bylaw challenges to court and to state agencies

If you think you need a lawyer to help you appeal a municipal or state permitting decision, contact me as soon as possible. There are very strict timelines for board and agency appeals.
